These Terms of Use govern access to and use of Wakupi, available at wakupi.com.
Wakupi is a digital service designed for families. It allows adults to discover, create, and organize adventures, activities, and challenges for children, keep a history of certain adventures, and generate digital souvenir Chronicles.
By creating an account or using Wakupi, you agree to these Terms.
Paid subscriptions are also subject to the Subscription and Billing Terms presented before purchase.

3. Adult Accounts and Family Use
You must be at least 18 years old and legally able to enter into an agreement to create or manage a Wakupi account.
Wakupi is designed to be managed by a parent, legal guardian, or other responsible adult. Children may participate in activities selected by an adult, but they may not independently create an account, purchase a subscription, or use features reserved for adults.
The adult account holder is responsible for the use of Wakupi by children under their supervision.
Wakupi is not intended for children to use independently without the involvement of a parent or responsible adult.
4. Account Registration and Security
Some features require an account.
You agree to provide accurate information and update it when necessary. You are responsible for keeping your login credentials confidential and for activity performed through your account.
If you believe that your account has been accessed without authorization, contact Wakupi as soon as possible at hello@wakupi.com.
Accounts are personal and may not be sold, transferred, or made available to anyone outside your household without permission.
5. Information About Children
An adult may choose to provide limited information to personalize an adventure, such as a child’s first name or nickname, age, or date of birth.
The adult decides what information to provide and confirms that they are authorized to provide it.
Wakupi recommends using a nickname when the child’s real identity is not necessary.
This information may be used to provide the service and, when the relevant feature is available, suggest age-appropriate activities.

6. Free Access and Paid Features
Wakupi allows users to explore the service by creating or completing up to three free adventures or stories.
After this limit is reached, certain features may require a monthly or annual subscription.
The features included in each plan, the price, the subscription period, and the automatic renewal terms will be displayed before purchase.
Payments, renewals, cancellations, and refund rules are explained in the Subscription and Billing Terms.
7. Adventures and Activities
Wakupi provides adventure templates and may allow users to personalize or automatically generate activities.
Some suggestions may be generated or adapted automatically based on information entered by the user. Although Wakupi works to provide useful content, generated or suggested content may occasionally contain an error, an inaccuracy, or an activity that is not appropriate for a particular child or situation.
Before presenting an activity to a child, the responsible adult must confirm that:
- the instructions are understandable;
- the activity is suitable for the child’s age and abilities;
- the location is appropriate and safe;
- the materials do not present a danger;
- no allergy, medical restriction, or other circumstance makes the activity unsuitable.
The adult must provide appropriate supervision throughout the activity and stop it if it can no longer be completed safely.
Wakupi does not replace the judgment, presence, or responsibility of a parent, guardian, or supervising adult.
8. Photos and Local Storage
Wakupi may allow users to select adventure or challenge photos from a computer, tablet, or mobile device.
As of the date of these Terms, these photos are not stored on Wakupi’s servers. They remain locally on the user’s device.
Photos that remain available on the device may be included in a souvenir Chronicle when the user generates and downloads a PDF.
If a photo is deleted, moved, or otherwise becomes unavailable on the device, it may no longer be available when a new PDF is generated.
Users should therefore generate and download their souvenir Chronicle if they want to preserve a version containing their photos.
You are responsible for the photos you select and for obtaining any permissions required to use them.
9. Souvenir Chronicles and Downloaded Files
Souvenir Chronicles are generated using the information, activities, and other elements selected by the user.
You are responsible for saving downloaded PDFs on your own device or storage service.
Wakupi does not guarantee that a previously generated file can be recovered if it was not downloaded or if locally stored elements required to generate it are no longer available.
PDFs are provided for personal and family use. They may not be sold or distributed publicly on a large scale without Wakupi’s prior written permission.
10. User Content
You may enter text, answers, preferences, or other information when creating an adventure.
You retain any rights you hold in the content you provide.
You give Wakupi permission to process that content only as reasonably necessary to operate the service, generate requested adventures, and create requested documents.
You may not provide content that:
- is unlawful, hateful, discriminatory, violent, or clearly inappropriate for a family service;
- violates another person’s privacy, image rights, intellectual property rights, or other legal rights;
- contains malicious software or is intended to disrupt the service;
- includes material that you are not authorized to use.
11. Prohibited Uses
You may not:
- use Wakupi for unlawful or fraudulent purposes;
- attempt to access another person’s account;
- bypass free-use limits or payment systems;
- interfere with or compromise the operation or security of the service;
- use automated tools to extract substantial amounts of content or data;
- copy or commercially exploit Wakupi’s templates, characters, illustrations, or content without permission;
- use the service in a way that could harm Wakupi, its users, or another person.
12. Intellectual Property
Wakupi and its visual identity, characters, illustrations, text, interfaces, graphics, logos, icons, adventure templates, quests, challenges, documents, and software elements are protected by applicable intellectual property laws.
Using the service does not transfer ownership of these materials to you.
Wakupi grants you a personal, limited, non-exclusive, non-transferable, and revocable license to use the service and the content available through your account for private and family purposes.
Unauthorized reproduction, adaptation, resale, extraction, or commercial use is prohibited.
13. Third-Party Services
Wakupi may rely on third-party providers for hosting, security, analytics, payment processing, or other technical services.
These providers may have their own terms and privacy policies. Wakupi is not responsible for a third-party service that it does not own or control, except where applicable law provides otherwise.
14. Service Availability and Changes
Wakupi uses reasonable efforts to keep the service available and functioning properly.
Access may occasionally be interrupted because of maintenance, updates, technical failures, internet connectivity issues, security concerns, or circumstances beyond Wakupi’s reasonable control.
Wakupi may add, change, or remove features to improve the service, protect its security, or comply with legal requirements.
If a significant change affects an active paid subscription, affected users will be notified as described in the Subscription and Billing Terms.
15. Account Suspension and Termination
Wakupi may suspend or terminate an account for:
- a serious or repeated violation of these Terms;
- fraud or attempted fraud;
- activity that threatens the security or operation of the service;
- conduct that violates Wakupi’s rights or the rights of another person;
- compliance with a legal obligation or lawful request.
When reasonably possible, Wakupi will notify the user and provide a way to contact us about the decision.
You may request account deletion by contacting hello@wakupi.com.
Account deletion may result in the loss of access to associated information and content, except for information Wakupi must retain for legal or legitimate business purposes.
Download any PDFs or other materials you want to keep before requesting account deletion.
16. Disclaimer of Warranties
To the extent permitted by applicable law, Wakupi is provided on an “as is” and “as available” basis.
Wakupi does not guarantee that the service will always be uninterrupted, error-free, or suitable for every child, family, location, or situation.
Suggestions and generated content are provided as organizational and entertainment tools. The responsible adult must review each activity and decide whether it is appropriate before presenting it to a child.
Some states do not allow certain warranty exclusions. In those states, the exclusions in this section apply only to the extent permitted by law.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Wakupi will not be responsible for indirect, incidental, special, or consequential damages resulting from the use of, or inability to use, the service.
Wakupi is not responsible for harm caused by:
- use of the service in violation of these Terms;
- inaccurate or incomplete information provided by a user;
- an activity performed without appropriate adult review or supervision;
- a device, internet connection, or third-party service outside Wakupi’s control;
- the deletion or unavailability of a file stored only on the user’s device;
- events that Wakupi could not reasonably predict or prevent.
Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited.

Both policies are available on the website.
19. Changes to These Terms
Wakupi may update these Terms to reflect changes to the service, its features, or applicable laws.
The current version will be posted on the website with its effective date.
If a material change affects users with an account, Wakupi may provide notice by email or through the service before the updated Terms take effect.
Continued use of Wakupi after the effective date of the updated Terms constitutes acceptance of those Terms, where permitted by applicable law.
20. Governing Law and Disputes
These Terms are governed by the laws of France, without depriving consumers of any mandatory protections available under the laws of their place of residence.
Before starting a formal claim, users are encouraged to contact Wakupi at hello@wakupi.com so that both parties can attempt to resolve the issue informally.
Nothing in these Terms prevents a consumer from using any rights or remedies available under applicable law.
